A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:00 p.m. on Wednesday, August 26, 2009
Councilors Present: President Ross in the Chair, all Councilors present.
Clergy:Reverend Sean Clark, Saints Memorial Church of God, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

1076 Message and order for confirmation of the appointment of Christie Gamp, as a member to the South End Landmark District Commission for a term expiring June 30, 2012. Referred to the Committee on Economic Development & Planning.
1076 Message and order for confirmation of the appointment of Diana Parcon, as a member to the South End Landmark District Commission for a term expiring June 30, 2011. Referred to the Committee on Economic Development & Planning.
1078 Petition of Boston Metro Shuttle, for a license to operate motor vehicles for the carriage of passengers for hire over certain streets in Boston. Referred to the Committee on City and Neighborhood Services.

1080 The Constable’s Bonds of Helen Y. Cameron, Xiomara Richmond, Maria Souto and Robert R. Wilson Jr., having been duly approved by the Collector-Treasurer, were received and approved under the usual terms and conditions.

0389 Councilor Murphy, on behalf of the Committee on Public Safety, submitted the following:On the message and order, referred on March 11, 2009, Docket #0389, authorizing the Police Commissioner to accept and expend a grant of $182,875.00 from the Massachusetts Executive Office of Public Safety and Security, for the purpose of funding the Boston Police Department Buffer Zone Protection Project, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
0869 On the message and order, referred on June 24, 2009, Docket #0869, authorizing the Police Commissioner to accept and expend the FY10 Public Safety Answering Point and Regional Emergency Communication Center Support and Incentive grant of $1,945,624.00 from the Executive Office of Public Safety State 911 Department, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
0870 On the message and order, referred on June 24, 2009, Docket #0870, authorizing the Police Commissioner to accept and expend the FY10 State 911 Department Training grant funds of $362,673.00 from the Executive Office of Public Safety and Security, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
0944 On the message and order, referred on July 8, 2009, Docket #0944, re-authorizing the Police Academy to establish in accordance with General Law Chapter 44, Section 53E ½ a revolving fund to accept from the fund up to a maximum of $200,000.00 for the purposes of purchasing training equipment, certifying instructors, updating facilities, and to providing funds for other training needs not otherwise budgeted for, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
0985 Councilor Feeney, on behalf of the Committee on Government Operations, submitted the following:On the message and order, referred on July 29, 2009, Docket # 0985, message and order approving an acceptance of the provisions of General Law (MGL) by Sections 60 and 156 of Chapter 27 of the Acts of 2009, a local option allowing cities and towns to impose an excise tax on all meals and beverages subject to the state sales tax, the Committee submitted a report recommending the order ought to pass. Councilor Tobin offered an amendment. The amendment did not pass, yeas 4 (Flaherty, Tobin, Turner, Yoon), nays 9. Councilor Tobin offered an amendment #2. The amendment did not pass and ruled out of order according to the Charter, page 13. Councilor Flaherty offered an amendment. The amendment did not pass and ruled out of order according to MGL 58, Sec. 1A. Councilor Flaherty resubmitted the amendment striking the word “residential” with no objection. The amendment did not pass. On motion of Councilor Feeney, the order was passed, yeas 10, nays 3 (Ciommo, Flaherty, Tobin).
0986 Councilor Feeney, on behalf of the Committee on Government Operations, submitted the following:On the message and order, referred on July 29, 2009, Docket # 0986, approving an acceptance of the provisions of General Law (MGL) by Sections 51, 52 and 154 of Chapter 27 of the Acts of 2009, a local option allowing cities and towns to increase the maximum local tax rate on hotel occupancy, submits a report recommending the order ought to pass. Councilor Tobin offered an amendment. The amendment did not pass, yeas 4 (Flaherty, Tobin, Turner, Yoon), nays 9. On motion of Councilor Feeney, the order was passed, yeas 11, nays 2 (Flaherty, Tobin).

1137 Resolution congratulating 19 persons in the Witherspoon Institute. The matters contained within the Consent Agenda were severally adopted. Adjourned at 2:10 p.m. on motion of President Ross in memory of Senator Edward M. “Ted” Kennedy, William Degan, Joseh Kelly, Alex Bonilla, John Garvey Bynoe, Robert Brown, Betty Takagi, and Henry Anthony Mateo, to meet again on Wednesday September 2, 2009 at 12:00 p.m.
