Certificate of Occupancy

The Boston Fire Department plays an important role in approving a Certificate of Occupancy for new residential units and businesses.  The Inspectional Services Department (ISD) will not issue a Certificate of Occupancy without input from the Boston Fire Department.  An owner or developer must provide information related to the safety and fire protection of a business before it can be occupied by the public, or in the case of residential units, closed upon.

Process:

  1. An owner or developer initiates the Certificate of Occupancy process by applying at ISD.  This request is faxed to the Fire Department's Certificate of Occupancy office located on the fourth floor of 1010 Massachusetts Avenue.

  2. After the receipt of this faxed request, an inspector is assigned to work with the owner or developer to collect the information we need to confirm the property is ready for public access.

  3. The property representative should note that many of the criteria listed below involve review and testing by the Boston Fire Department.   This can delay turning over a property when sufficient time has not been set aside for the Certificate of Occupancy process.

  4. When all the information below--which applies to the property--has been collected and is satisfactory, all testing is completed and a final walkthrough is conducted. The Fire Department then signs off the request and the Certificate of Occupancy may be picked up.

  5. Facilities having any area within deemed as a “Place of Assembly” such as conference rooms, pool areas, dining halls, etc. with occupant capacity (over 49 persons) must also obtain a Place of Assembly permit.

  • A new Comprehensive Model Fire Code (527 CMR 1.00) has been adopted by the Division of Fire Services and the State Fire Marshal's Office effective January 1, 2015 replacing the current 527 CMR.

    The new code adopts, in large part, the National Fire Prevention Association’s (NFPA) Model Fire Code (NFPA-1- 2012 Edition), with Massachusetts amendments. The new code should result in an improved, more comprehensive fire safety code, using consensus standards recognized throughout the nation. This new code will replace the current 527 CMR.   • New Ordinance Enacted in Boston

  • Effective April 1, 2014 Boston has a Revised Upholstered Furniture, Molding Seating and Re-upholstered Furniture Policy

    Effective April 1, 2014 the Boston Fire Department shall modify its upholstered seating regulations to more closely align with the current state regulations: 527 CMR 1.00 c 12, "Upholstered Furniture, Molded Seating and Re-upholstered Furniture.  This change will effectively reduce the number of regulated use groups in the City of Boston.

    Although this modified policy closely follows the requirements of the Commonwealth of Massachusetts Regulations, there are still some notable exceptions that shall be strictly enforced.  This policy is subject to modification at the discretion of the Boston Fire Marshal.
