A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:25 P.M. on Wednesday, June 30, 2010
Councilors Present: President Ross in the Chair. All members present.
Clergy:Reverend Burns Stanfield, Fourth Presbyterian Church, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

0992 President Ross moved to adopt the minutes from the June 23, 2010 meeting. Motion prevailed. Message and order for confirmation of the appointments of constables authorized to serve civil process upon filing of their bonds for the period commencing May 1, 2010 and ending April 30, 2013. On motion of Councilor Ross, the rules were suspended; the appointments were confirmed.
0993 Message and order authorizing the Fire Department to establish and maintain a revolving fund which shall be credited with all receipts received pursuant to costs associated with M.G.L. Chapter 21E, the Massachusetts Oil and Hazardous Material Release Prevention and Response act. Referred to the Committee on Public Safety.
0994 Petition of Nautical Tours Inc., for a license to operate motor vehicles for the carriage of passengers for hire over certain streets in Boston. Referred to the Committee on Neighborhood Services and Veteran Affairs.
0995 Communication was received from Kathleen Kiely-Becchetti, Executive Director, Boston Retirement Board re: Certification and Transmittal to City Council of Boston Retirement Board FY2011 Budget. Placed on File.
0996 Communication was received from the City Clerk of the filing by the Boston Redevelopment Authority of the “Fifth Amendment to Report and Decision on Camfield Estates Chapter 121A Project”. Placed on File.
0997 Notice was received from the City Clerk of the filing of the Downtown Business Improvement District Petition. Referred to the Committee on Economic Development & Planning.

0999 Councilors Ross, Pressley, Arroyo for all Councilors offered the following: Order approving a petition for a Special Law re: the potential layoffs and closure of several neighborhood branches across the Boston Public Library system. On motion of Councilor Ross, the rules were suspended; the order as passed; yeas 13. Motion prevailed.
1000 Councilor Turner for all Councilors offered the following: Order for a hearing regarding efforts to curb illegal gun trafficking in Boston and Massachusetts. Referred to the Committee on Public Safety.
1001 Resolution supporting Governor Patrick’s Crime Bill H.4102 (to reduce violence Committed with illegally trafficked guns). On motion of Councilor Turner, the rules were suspended; the resolution was adopted; yeas 12, nays 0. Absent or not voting 1 (LaMattina).
1002 Councilors Yancey and Turner offered the following: Order for a hearing regarding the Campus High School Urban Renewal Plan. Referred to the Committee on Education.
1003 Councilor Yancey offered the following: Order for a hearing regarding the BRA’s proposed eminent domain taking for the Post Office Square and garage project. Referred to the Committee on Economic Development and Planning.
1004 Councilors Yancey and Pressley offered the following: Order for a hearing regarding the regulation of street memorials. Referred to the Committee on City and Neighborhood Services and Veteran Affairs.
0947 Councilor Ciommo called Docket #0947, message and order approving the compensating balance agreement by and between the City and Citizens Bank for the provision of Lockbox Services for the Collection of Real Estate, Personal Property, Motor Vehicle Excise and Boat Excise Taxes Services, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was passed.
0948 Councilor Ciommo called Docket #0948, message and order approving the compensating balance agreement by and between the City and Citizens Bank for the provision of Credit/Debit Card Banking Services, from the Committee on Ways and Means. 0949 Councilor Ciommo called Docket #0949, message and order approving the compensating balance agreement by and between the City and Citizens Bank for the provision of Banking Services, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was passed.
0950 Councilor Ciommo called Docket #0950, message and order approving the compensating balance agreement by and between the City and Citizens Bank for the provision of Direct Deposit Account Services, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was passed.
0540 Councilor Ciommo called Docket #0540, message and order for a loan of $6,640,000.00 (Six Million Six Hundred Forty Thousand Dollars) for acquiring land, or interests in land, for any purpose for which the City is or may hereafter be authorized to acquire land or interests therein; and for the construction of buildings, or for additions to such buildings where such additions increase the floor space of said buildings, including the cost of original equipment and furnishings of said buildings, and/or for remodeling, reconstructing, or making extraordinary repairs to public buildings owned by the City, including original equipment and landscaping, paving and other site improvements incidental or directly related to such remodeling, reconstruction or repair, and or for the installation of fire alarm systems including extending and improving such installation, and/for the cost of engineering or architectural services for plans and specification of for the purposes of city departments including the Boston Center for Youth and Families, Fire, Library and Public Works Departments, from the Committee on Ways and Means. 0541 Councilor Ciommo called Docket #0541, message and order for a loan of $37,215,000.00 (Thirty Seven Million Two Hundred Fifteen Thousand Dollars) for the remodeling, reconstructing, or making extraordinary repairs to public buildings owned by the City, including original equipment and landscaping, paving and other site improvements incidental or directly related to such remodeling, reconstruction or repair, and/or for energy conservation, alternative energy or renewable energy improvements to public building or facilities, and/or for the installation of fire alarm systems including extending and improving such installation, for the purposes of city departments including the School Department, from the Committee on Ways and Means. 0543 Councilor Ciommo called Docket #0543, message and order for a loan of $32,195,000.00 (Thirty Two Million One Hundred Ninety Five Thousand Dollars) for the development, design, purchase and installation of computer hardware, computer software, other data processing equipment and computer assisted integrated financial management and accounting systems, for the acquisition of departmental equipment, and for fire alarm or police communication installations and for the purpose of extending and improving such installations for the purposes of city departments including the Department of Innovation and Technology, Library and School Department, from the Committee on Ways and Means. 0544 Councilor Ciommo called Docket #0544, message and order for a loan of $20,705,000.00 (Twenty Million Seven Hundred Five Thousand Dollars) for the original construction of public ways of the extension or widening thereof, including land damages and the cost of pavement and sidewalks laid at the time of said construction, or for the construction of stone, block, brick, cement concrete, bituminous concrete, bituminous macadam or other permanent pavement of similar lasting character, and or for the construction of sidewalks of brick, bituminous concrete, stone or concrete, and/or for construction of walls or dikes for the protection of highways or property, and/or for traffic signal, or public lighting installations, and for the purpose of extending and improving such installations, and/or for the cost of engineering or architectural services for plans and specifications for the purposes of city departments including the Public Works and Transportation Department, from the Committee on Ways and Means. 0545 Councilor Ciommo called Docket #0545, message and order for a loan of $5,605,000.00 (Five Million Six Hundred Five Thousand Dollars) for the traffic signal, or public lighting installations, and for the purpose of extending and improving such installation, and/or for the cost of engineering or architectural services for plans and specification for the purposes of city departments including the Public Works and Transportation Department, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was read a second time and again passed, yeas 12, nays 1 (Turner).1
0546 Councilor Ciommo called Docket #0546, message and order for a loan of $11,555,000.00 (Eleven Million Five Hundred Fifty Five Thousand Dollars) for the construction of municipal outdoor recreational and athletic facilities, including the acquisition and development of land and the construction and reconstruction facilities, for the acquisition of departmental equipment and/ or for the cost of engineering or architectural services for plans and specifications, for the purposes of city departments including the Parks and Recreation and School Departments, from the Committee on Ways and Means. 0547 Councilor Ciommo called Docket #0547, message and order for a loan of $445,000.00 (Four Hundred Forty Five Thousand Dollars) for developing land for burial purposes and for constructing paths and avenues and embellishing the grounds in city-owned cemeteries, for the purposes of city departments including the Parks and Recreation Department, from the Committee on Ways and Means. 0548 Councilor Ciommo called Docket #0548, message and order for a loan of $6,920,000.00 (Six Million Nine Hundred Twenty Thousand Dollars) for the construction or reconstruction of bridges of stone or concrete or of iron superstructure and/or for the cost of engineering or architectural services for plans and specification, for the purposes city departments including the Public Works Department, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was read a second time and again passed, yeas 12, nays 1 (Turner).
0549 Councilor Ciommo called Docket #0549, message and order for a loan of $5,655,000.00 (Five Million Six Hundred Fifty Five Thousand Dollars) for, but not limited to, energy conservation, alternative energy or renewable energy improvements to public building or facilities, the construction of walls or dikes for the protection of highways or property, the laying and relaying of water mains, and/or the cost of departmental equipment for the purposes of city departments including the Environment, Fire and Neighborhood Development Department, from the Committee on Ways and Means. 0550 Councilor Ciommo called Docket #0550, message and order for a loan of $405,000.00 (Four Hundred and Five Thousand Dollars) for the purposes of planting shade trees, planning, designing, acquiring land for, constructing and originally equipping structures and facilities it is authorized to construct, and for remodeling, reconstructing, or making major alterations, additions and repairs to the existing facilities including original equipment and landscaping, paving and other site improvements incidental or directly related to such remodeling, reconstruction or repair, for the purposes of city departments including Parks and Recreation Department, from the Committee on Ways and Means. 0946 Councilor Ciommo called Docket #0946, message and order for Annual Appropriation for the School Department for FY2011. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was passed, yeas 12, nays 2 (Turner, Yancey).
0539 Councilor Ciommo called Docket #0539, message and order approving an appropriation of $35,000,000.00 (Thirty Five Million Dollars) to the Other Post Employment Benefits (OPEB) Liability Trust Fund authorized under MGL Chapter 32B, Sec.20, as added by Chapter 479 of the Acts of 2008 and approved by this body, from the Committee on Ways and Means. Hearing no objection, the matter was before the body. On motion of Councilor Ciommo, the order was passed.
