A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:10 on Wednesday, December 9, 2009
Councilors Present: President Ross in the Chair, all Councilors present.
Clergy:President Ross called for a moment of Silence and the meeting was opened with the pledge of allegiance to the flag.

Docket Short Description
1481 President Ross moved to adopt the minutes from the December 2, 2009 meeting. Motion prevailed. Message and order authorizing the Police Commissioner to accept and expend a grant of $520,000.00 from the Executive Office of Public Safety, for the purpose of funding Civilian Community Service Officers. On motion of Councilor Murphy, the rules were suspended; the order was passed.
1482 Message and order authorizing the Police Commissioner to accept and expend a grant of $25,000.00 from the Stanton Foundation for the purpose of providing an additional police presence in the Ronan Dog Park in District C-11. On motion of Councilor Murphy, the rules were suspended; the order was passed.
1483 Message and order approving a Preservation Restriction Agreement by and between Allen House Condominium Trust, 1682 Washington Street and the Trust for Architectural Easements, pursuant to M.G.L. Chapter 184, Section 32. Referred to the Committee on Economic Development and Planning.
1484 Communication was received from Mass DOT Highway, regarding Layout No. 7683 Alteration, Conveyance and Release on 10/15/2009. Placed on file.
1485 Communication was received from Geraldine Cuddyer, Chair, Board of Election, certifying results of election held for Mayor and the Boston City Council. Placed on file.
1360 Councilor Feeney, on behalf of the Committee on Government Operations, submitted the following: The ordinance, referred on November 4, 2009, Docket #1360, amending Chapter 8 of the Ordinances of 1999 and Chapter 12 of the Ordinances of 2004 (Extending Protection for Tenants Facing Displacement by Condominium or Cooperative Conversion), to extend the provisions of that Ordinance for an additional five years from December 31, 2009 to December 31, 2014, the Committee submitted a report recommending the ordinance ought to pass. Councilor Murphy in the Chair. Councilor Ross in the Chair. On motion of Councilor Feeney, the report was accepted; the ordinance was passed.
1387 Councilor Ciommo, on behalf of the Committee on Ways and Means, submitted the following: The order, referred on November 18, 2009, Docket #1387, that pursuant to Chapter 40, section 56, the residential factor in the City of Boston for FY2010 shall be the minimum residential factor as determined by the Commissioner of Revenue pursuant to M. G. L., Chapter 58, section 1A, and be it further that pursuant to Chapter 403 of the acts of 2000, a residential exemption in the amount of value equal to thirty percent (30%) of the average assessed value of all Class One-Residential parcels in the City of Boston be, and hereby is approved for Fiscal Year 2010, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Ciommo, the report was accepted; the order was passed.
1292 Councilor Yoon, on behalf of the Committee on Post Audit and Oversight, submitted the following: The order, referred on October 21, 2009, Docket #1292, for the confirmation of the re-appointment of Mark MacDonnell to the Audit Committee, the Committee submitted a report recommending the appointment be confirmed. On motion of Councilor Yoon, the report was accepted; the appointment was confirmed.
1381 Councilor Murphy, on behalf of the Committee on Public Safety, submitted the following: The message and order, referred on November 18, 2009, Docket #1381, authorizing the Mayor’s Office of Emergency Preparedness to accept and expend a grant of $1,259,820.00 from the Federal Government under the American Recovery and Reinvestment Act of 2009, for the purpose of procuring equipment for the City of Boston’s public safety agencies, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1248 The message and order, referred on October 7, 2009, Docket #1248, authorizing the Police Commissioner to accept and expend a grant of $750,000.00 from the U.S. Department of Justice, Office on Violence Against Women for the Boston Multi-Disciplined Advocacy Support Project, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1249 The message and order, referred on October 7, 2009, Docket #1249, authorizing the Police Commissioner to accept and expend a grant of $491,265.00 from National Institute of Justice, for the purpose of decreasing the backlog of unsolved cold case homicide investigations by the Boston Police Department’s Unsolved Case Squad, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1250 The message and order, referred on October 7, 2009, Docket #1250, authorizing the Police Commissioner to accept and expend a grant of $312,794.00 from the U.S. Department of Justice, for the Forensic DNA Backlog Reduction Program, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1251 Councilor Murphy, on behalf of the Committee on Public Safety, submitted the following: The message and order, referred on October 7, 2009, Docket #1251, authorizing the Police Commissioner to accept and expend a grant of $200,000.00 from the U.S. Department of Justice, Office of Justice Programs, for the purpose of predictive statistical analysis, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1253 The message and order, referred on October 7, 2009, Docket #1253, authorizing the Police Commissioner to accept and expend a grant of $75,000.00 from the U.S. Department of Justice, for the purpose of supporting law enforcement response to human trafficking, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1254 The message and order, referred on October 7, 2009, Docket #1254, authorizing the Police Commissioner to accept and expend a grant of $70,453.00 from the Massachusetts State Police under the Paul Coverdell Forensic Science Improvement Grant, for the purpose of training costs associated with the development of knowledge, skills and abilities for newly hired and existing staff members of the Crime Lab Unit, Ballistics Unit, Latent Print Unit and Crime Scene Response Unit, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1435 The message and order, referred on December 2, 2009, Docket #1435, authorizing the Police Commissioner to accept and expend grant of $66,000.00 from the Commonwealth of Massachusetts Executive Office of Public Safety and Security’s Highway Safety Division, for the purpose of the FY 2010 Traffic Enforcement and Equipment Program, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1436 The message and order, referred on December 2, 2009, Docket #1436, authorizing the Police Commissioner to accept and expend a grant of $20,000.00, passed through from the Beth Israel Deaconess Medical Center for the purposes of studying the geography of violence and alcohol in Boston, the Committee submitted a report recommending the order ought to pass. On motion of Councilor Murphy, the report was accepted; the order was passed.
1486 Councilor Yancey offered the following: Order requesting certain information under Section 17F: List of all City of Boston Vehicles owned or leased as of September 30, 2009. On motion of Councilor Yancey, the rules were suspended; the order was passed.

0814 Councilor Yancey called Docket #0814, order approving a petition for a Special Law re: An act authorizing the Retirement Board to grant certain retirement benefits to Boston Firefighter Allen Curry, from the Committee on Government Operations. Hearing no objection, the matter was before the body. Councilor Murphy moved that Docket #0814 be laid on the table until after New Year. Councilor Flaherty seconded the motion and the matter was laid on the table; yeas 9, nays 4; (Councilors Feeney, Linehan, Yancey and Yoon) The Chair moved adoption of a Consent Agenda containing the following matters:

Adjourned at 1:50 p.m. on motion of President Ross in memory of Rosemarie Monahan, Bill Smith, Eleanor Baldassari, Arena Curtin, to meet again on Wednesday December 16, 2009 at 12:00 p.m. The papers acted upon at the foregoing meeting of the City Council, which contain action requiring the approval of the Mayor, were deposited in the Mayor’s Office on December 11, 2009.
