A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:10 on Wednesday, November 18, 2009
Councilors Present: President Ross in the Chair, absent Councilors Connolly and Murphy.
Clergy:Reverend Gareth Evans, St. John’s Episcopal Church, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

1389 President Ross moved to adopt the minutes from the November 4, 2009 meeting. Motion prevailed. on motion of Councilor Ross, Docket No, 1389 was taken out of order. Councilor Ross in absence of Councilor Connolly offered the following: Resolution in support of Transgender Awareness Week. On motion of Councilor Ross, the rules were suspended; the resolution was adopted; 11 yeas, nays 0. Absent or not voting 2 (Connolly and Murphy).
1381 Message and order authorizing the Mayor’s Office of Emergency Preparedness to accept and expend a grant of $1,259,820.00 from the Federal Government under the American Recovery and Reinvestment Act of 2009, for the purpose of procuring equipment for the City of Boston’s public safety agencies. Referred to the Committee on Public Safety and the Committee on Federal Stimulus Oversight.
1382 Notice was received from the Mayor of his absence from the City on November 9, 2009 until November 13, 2009. Placed on file.
1078 Councilor LaMattina, on behalf of the Committee on City and Neighborhood Services, submitted the following: On the petition, referred on August 26, 2009, Docket #1078, of Boston Metro Shuttle, for a license to operate motor vehicles for the carriage of passengers for hire over certain streets in Boston, the Committee submitted a report recommending the petition ought to be denied. The report was accepted; the petition was denied.

1362 Councilor Linehan, on behalf of the Committee on Economic Development and Planning, submitted the following: On the message and order, referred on November 4, 2009, Docket #1362, approving the issuance of tax exempt bonds in the principal amount not to exceed $66,000,000.00 from the Boston Industrial Development Financing Authority (BIDFA), for the project at 185 Franklin Street Investment, LLC, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1383 Councilor Ross offered the following: Order calling on the Transportation Department to designate Huntington Avenue, from Longwood Avenue to Ruggles Street, as “Lieutenant Kevin M. Kelley Avenue” to honor and commemorate his honorable sacrifice in the line of duty. On motion of Councilor Ross, the rules were suspended; the order was passed; 11 yeas, nays 0. Absent or not voting 2 (Connolly and Murphy).
1384 Councilors Consalvo, Flaherty, Feeney, Ciommo, LaMattina, Linehan, Tobin, Yancey and Yoon offered the following: Order for a hearing to discuss the purchase, installation, rotation and utilization of vandalism deterrent technology to protect property and reduce costs throughout the City. Referred to the Committee on City and Neighborhood Services.
1385 Councilors LaMattina, Murphy, Feeney, Ciommo, Consalvo, Flaherty, Linehan, Yancey, Turner, Yoon, Tobin and Ross offered the following: Resolution supporting the preservation of the USS Constitution’s heritage and time-honored traditions of daily gun salutes and playing of the national anthem in Boston’s Charlestown Navy Yard. On motion of Councilor LaMattina, the rules were suspended; the resolution was adopted; 11 yeas, nays 0. Absent or not voting 2 (Connolly and Murphy).
1386 Councilors Tobin, Ross, Turner, Yancey, Yoon, Linehan, LaMattina, Consalvo and Ciommo offered the following: Order for a hearing to discuss voter privacy at the City’s polling sites and election ballot design. Referred to the Committee on Government Operations.
1387 Councilor Ross offered the following: Order that pursuant to Chapter 40, section 56, the residential factor in the City of Boston for FY2010 shall be the minimum residential factor as determined by the Commissioner of Revenue pursuant to M. G. L., Chapter 58, section 1A, and be it further that pursuant to Chapter 403 of the acts of 2000, a residential exemption in the amount of value equal to thirty percent (30%) of the average assessed value of all Class One-Residential parcels in the City of Boston be, and hereby is approved for Fiscal Year 2010. Referred to the Committee on Ways and Means.
1388 Councilor Ross offered the following: Order that pursuant to Chapter 182, section 14 of the Acts of 2008, the income limit for the 41A Tax Deferral shall be established annually according to the income limit for single seniors who are not filing as head of household established in the “circuit breaker” tax credit; and be it further that the income limit of $51,000 for the 41A Tax Deferral for Fiscal Year 2010 in the City of Boston is hereby approved. Referred to the Committee on Ways and Means.
1390 Councilor Ross offered the following: Order for the appointment of temporary employee Deborah Shah in City Council. Passed under suspension of the rules.
1429 The Chair stated that in absence of objection, one late-filed matter was added to the Agenda. No objection being heard, the following matter was added:Councilors Turner, Linehan, Feeney, Consalvo, Ciommo, Tobin, Yancey, Yoon, Ross and Flaherty offered the following: Order for a hearing regarding the closing of the Empowerment Zone Program Boston Connects, Inc. Referred to the Committee on Economic Development and Planning. The Chair moved adoption of a Consent Agenda containing the following matters:

1431 Resolution declaring November 20th to December 20th as Survivors of Homicide Victims Awareness Month.
1432 Councilor Yancey offered the following: Resolution in memory of Hugh Morgan Hill, Ph.D. (Brother Blue). The matters contained within the Consent Agenda were severally adopted. Adjourned at 1:45 p.m. on motion of President Ross in memory of Jean M. Rooney, Theocharis “Harry” Vasiliades, Delia Connolly, Ronnie Whiteside, John Flaherty, Manny Valle, Patricia Maher, Joseph McGonagle, Donald Woodside, Councilor Tobin’s Grandfather Philip C. Freeman, Hugh Morgan Hill (Brother Blue), Barbara Maze, Frank Fabiano, Jean Archambeau and with well wishes to the Mayor on his recovery from surgery, Happy Birthday wishes to Amanda and Anthony Consalvo and Councilor Feeney’s husband and Larry and Shariff Yancey, to meet again on Wednesday December 2, 2009 at 12:00 p.m. The papers acted upon at the foregoing meeting of the City Council, which contain action requiring the approval of the Mayor, were deposited in the Mayor’s Office on November 20, 2009.
