A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:00 pm on Wednesday, October 7, 2009
Councilors Present: President Ross in the Chair, all Councilors present.
Clergy:City Clerk Rosaria Salerno, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

Docket Short Description
1248 President Ross moved to adopt the minutes from the September 30, 2009 meeting. Motion prevailed. Message and order authorizing the Police Commissioner to accept and expend a grant of $750,000.00 from the U.S. Department of Justice, Office on Violence Against Women for the Boston Multi-Disciplined Advocacy Support Project. Councilor Murphy in the Chair. Referred to the Committee on Public Safety.
1249 Message and order authorizing the Police Commissioner to accept and expend a grant of $491,265.00 from National Institute of Justice, for the purpose of decreasing the backlog of unsolved cold case homicide investigations by the Boston Police Department’s Unsolved Case Squad. Referred to the Committee on Public Safety.
1250 Message and order authorizing the Police Commissioner to accept and expend a grant of $312,794.00 from the U.S. Department of Justice, for the Forensic DNA Backlog Reduction Program. Referred to the Committee on Public Safety.
1251 Message and order authorizing the Police Commissioner to accept and expend a grant of $200,000.00 from the U.S. Department of Justice, Office of Justice Programs, for the purpose of predictive statistical analysis. Referred to the Committee on Public Safety.
1252 Message and order authorizing the Department of Neighborhood Development to apply for, accept and expend $200,000.00 from the U.S. Environmental Protection Agency (EPA) Brownfields Assessment Grant, to provide federal financial assistance to local governments and other eligible entries for Brownfields revitalization, including grants for assessment, cleanup and job training. Referred to the Committee on Economic Development and Planning. Councilor Linehan moved reconsideration of Docket #1252. Reconsideration prevailed. Councilor Linehan moved to amend Docket #1252 by striking the words “accept and expend”. On motion of Councilor Linehan, Docket #1252, as amended, was passed.
1253 Message and order authorizing the Police Commissioner to accept and expend a grant of $75,000.00 from the U.S. Department of Justice, for the purpose of supporting law enforcement response to human trafficking. Referred to the Committee on Public Safety.
1254 Message and order authorizing the Police Commissioner to accept and expend a grant of $70,453.00 from the Massachusetts State Police under the Paul Coverdell Forensic Science Improvement Grant, for the purpose of training costs associated with the development of knowledge, skills and abilities for newly hired and existing staff members of the Crime Lab Unit, Ballistics Unit, Latent Print Unit and Crime Scene Response Unit. Referred to the Committee on Public Safety. President Ross in the Chair.
1255 Communication was received from Mass Highway re: Bridge Replacement Morton Street over MBTA & CSX Railroad Project File No. 603654 Bridge No. B-160163. Placed on file.
1256 Communication was received from the City Clerk of the filing by the Boston Residency Compliance Commission regarding the Annual Report (2008-2009). Placed on file.
1257 Communication was received from the Commonwealth of Mass. Middlesex Canal Commission regarding their Executive Committee Meeting Minutes on September 10, 2009. Placed on file.
1258 Notice was received from the City Clerk in accordance with Chapter 6 of the Ordinances of 1979 re: actions taken by the Mayor on papers acted upon by the City Council at its meeting on September 16, 2009. Placed on file.
1175 Councilor Murphy, on behalf of the Committee on Public Safety, submitted the following: On the message and order, referred on September 16, 2009, Docket #1175, authorizing the Police Commissioner to accept and expend a grant of $949,599.00 from the U.S. Department of Justice, for the purpose of supporting crime prevention and law enforcement, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1177 On the message and order, referred on September 16, 2009, Docket #1177, authorizing the Police Commissioner to accept and expend a grant of $113,030.00 from the Massachusetts Executive Office of Public Safety and Security, for the purpose of funding the Boston Police Department’s FY 08 Buffer Zone Project, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1178 Councilor Murphy, on behalf of the Committee on Public Safety, submitted the following: On the message and order, referred on September 16, 2009, Docket #1178, authorizing the Police Commissioner to accept and expend a grant of $11,600.00 from the U.S. Department of Justice, Office of Violence Against Women, for training for law enforcement and improved services for response to violence and abuse of women later in life, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1220 On the message and order, referred on September 30, 2009, Docket #1220, authorizing the Police Commissioner to accept and expend a grant of $500,000.00 from the U.S. Department of Justice, Bureau of Justice Assistance funded under FY09 Smart Policing: Evidence Based Law Enforcement grant program, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1222 On the message and order, referred on September 30, 2009, Docket #1222, authorizing the Police Commissioner to accept and expend a grant of $125,000.00 from the FY09 Paul Coverdell National Forensic Sciences Improvement Act Formula funded by the National Institute of Justice, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1225 On the message and order, referred on September 30, 2009, Docket #1225, authorizing the Police Commissioner to accept and expend the FY08 VAWA STOP grant of $38,160.00, from the Executive Office of Public Safety and Security to support the BPD’s Civilian Domestic Violence Advocate, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1221 Councilor Linehan, on behalf of the Committee on Economic Development & Planning, submitted the following: On the message and order, referred on September 30, 2009, Docket #1221, authorizing the Department of Neighborhood Development to apply for, accept and expend $400,000.00 from the U.S. Environmental Protection Agency (EPA) Brownfields Assessment Grant, the Committee submitted a report recommending the order ought to pass. 1259 Councilors Murphy, Flaherty, LaMattina, Linehan, Yancey, Turner, Feeney, Ciommo and Ross offered the following: Order for a hearing to discuss what is being done to manage the rodent problem in the City. Referred to the Committee on City and Neighborhood Services.
1260 Councilors Tobin, Turner, Yancey, Yoon, LaMattina, Ciommo, Consalvo, Feeney, Flaherty, Linehan, Connolly and Murphy offered the following: Order for a hearing to examine the feasibility of banning the use of mobile phones for typing, or texting, while operating a motor vehicle within the City of Boston. 1261 Councilors Linehan, Flaherty and Turner offered the following: Order approving a Petition for a Special Law regarding An Act Relative to Certain Affordable Housing in the City of Boston. Referred to the Committee on Government Operations. Councilor Murphy in the Chair.
1262 Councilors Ross, Murphy, Feeney, Consalvo, Ciommo, Flaherty, LaMattina, Linehan, Tobin, Turner, Yancey and Yoon offered the following: Order for a hearing to discuss RCN interfering with the legal rights of disabled, elderly and low-income building residents regarding cable television service. 1263 Councilors Turner, Yancey, Yoon, Feeney, Consalvo, Linehan, Murphy, Tobin, Flaherty and LaMattina offered the following: Order for a hearing regarding the need for more crossing guards. 1264 Councilors Murphy and Ross on behalf of all Councilors offered the following: Resolution urging the General Court to enact Criminal Offender Record Information Act reform as soon as possible. On motion of Councilor Murphy, the rules were suspended; the resolution was adopted; yeas 13.
1265 Order for a hearing to discuss the implementation and effectiveness of the 2005 CORI Ordinance and to review possible issues and changes to CBC 4-7. Referred to the Committee on Public Safety.
1266 Councilor Ross for Councilor Ciommo offered the following: Order for the appointment of temporary employee Anthony Gesualdi in City Council. Passed under suspension of the rules.
1267 Councilor Ross for Councilor Yoon offered the following: Order for the appointment of temporary employee Mary Grissom in City Council. Passed under suspension of the rules.
1223 Councilor Murphy called Docket #1223, message and order authorizing the Fire Commissioner to accept and expend a grant of $80,000.00 from the Massachusetts Executive Office of Public Safety and Security, for the purpose of funding the Boston Fire Department’s FY 08 Buffer Zone Project, from the Committee on Public Safety. Hearing no objection, the matter was before the body. On motion of Councilor Murphy, the order was passed.
1224 Councilor Murphy called Docket #1224, message and order authorizing the Fire Commissioner to accept and expend a grant of $55,000.00 from the Massachusetts Executive Office of Public Safety and Security, for the purpose of funding the Boston Fire Department’s FY 08 Buffer Zone Project, from the Committee on Public Safety. Hearing no objection, the matter was before the body. On motion of Councilor Murphy, the order was passed. The Chair moved adoption of a Consent Agenda containing the following matters:

Adjourned at 1:35p.m. on motion of President Ross in memory of William Gorman, Kevin Bourque, Lemont McLaughlin, Neil Chin, Mary Gavin, Martin “Barts” Nee, Robert Fleming, Beverly Bosse, Michael O’Donnell and Jean Cahill, to meet again on Wednesday October 21, 2009 at 12:00 p.m. The papers acted upon at the foregoing meeting of the City Council, which contain action requiring the approval of the Mayor, were deposited in the Mayor’s Office on October 9, 2009.
