Permitting Refund Policy
SEE CITY OF BOSTON ORDINANCES, TITLE 14, SECTION 48
- WHEN APPLICANT IS ENTITLED TO A REFUND
- An applicant is entitled to a refund when the permit has been denied by the Department of Inspectional Services.
- An applicant is entitled to a refund when the homeowner has abandoned the project and construction work has not commenced.
- An applicant is entitled to a refund if they have paid a fee to have their case heard before the Board of Appeals and subsequently withdraws the appeal. The applicant is only entitled to the refund if the withdrawal occurs before a public advertisement.
- An applicant is entitled to a refund if they overestimated the cost of completion, and the cost breakdown indicates that the fee paid exceeds the fee required for the actual work performed.
- WHAT THE APPLICANT MUST SUBMIT
- COPY OF THE APPLICATION (if the application has been abandoned, it must be stamped by ISD as abandoned).
- COPY OF RECEIPT INDICATING THE AMOUNT OF THE FEE PAID
- COPY OF CANCELLED CHECK (if applicable)
- COPY OF BOARD OF APPEAL WITHDRAWAL (if applicable)
- A COST BREAKDOWN IF THE FEE HAS BEEN OVERPAID
- WHAT IS THE AMOUNT OF THE REFUND?
- A portion of the fee will be retained per City of Boston Code, Ordinance, Title 14 Section 48. The retained fee will be as follows:
- If the fee paid is less than One Hundred Dollars ($100), the portion retained will be twenty-five Dollars ($25.00)
- If the fee paid exceeds One Hundred Dollars ($100), the portion retained will be Fifty Dollars ($50).
- The refund application form may be faxed to the Budget Unit at (617) 635-5924.
- WHEN THE APPLICANT MAY EXPECT TO RECEIVE THE REFUND
- The inspectors must visit the site to verify that construction has not been commenced. Therefore, processing time is approximately 6-8 weeks after all appropriate information has been received by the Budget Office.
