Committee to Legalize Occupancy

  1. WHEN THIS IS USED
    1. When building/structure does not have a legal occupancy on record. Counter 1 at ISD may provide the application with information on legal occupancies.

  2. WHAT IS THE PROCESS
    • The applicant will complete a long form application describing the work to be completed.
    • The staff gathers information on the structure (building history, tax assessment information etc)
    • ISD forwards the information to the occupancy committee.
    • The occupancy committee reviews the information.

  3. OCCUPANCY COMMITTEE APPROVES
    • If the occupancy committee approves the permit for zoning purposes, it is then reviewed by the plan examiners to ensure compliance with the building code.
    • Upon notification, the applicant will return to ISD, pay the appropriate fee, and the permit will be issued.

  4. OCCUPANCY COMMITTEE DOES NOT APPROVE
    • The applicant may proceed to the Board of Appeals
