A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:05 on Wednesday, November 17, 2010
Councilors Present: President Ross in the Chair. All members present.
Clergy:Rabbi Naftoli Bier, Kollel of Greater Boston, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

1561 Councilors Connolly, Arroyo, Pressley, Ross, Turner, Feeney, Consalvo, LaMattina, Linehan, Ciommo and Murphy offered the following: Resolution in support of Transgender Awareness Week. On motion of Councilor Connolly, the rules were suspended, the resolution was adopted, 11 yeas, nays 0. Absent or not voting 1 (Yancey).
1560 Councilors Connolly, Ciommo, Arroyo, Yancey, Murphy, Linehan, Ross, Pressley, LaMattina, Turner, Feeney and Consalvo offered the following: Order for a hearing on caffeinated alcoholic beverages. Referred to the Committee on Environment and Health. President Ross moved to adopt the minutes from the November 3, 2010 meeting. Motion prevailed.
1539 Message and ordinance amending CBC Ordinances, Section 9-11.4 “Security in Elderly/Handicapped Housing Development” and Section 11-1.7 “Crime Prevention Surveys”. Filed in the Office of The City Clerk on November 16, 2010. Referred to the Committee on Government Operations.
1540 Message and order authorizing the City to accept a grant of Thirteen Million Dollars ($13,000,000.00) from the Boston Redevelopment Authority, for the purpose of designing, constructing, renovating and equipping the Quincy Upper School. Referred to the Committee on Ways and Means. Councilor Connolly moved reconsideration. Reconsideration prevailed. Referred to the Committee on Ways and Means and Education.
1541 Message and order approving an appropriation of $550,000.00 for the feasibility study for major rehabilitation of the Quincy Upper School. The statement of interest for the Quincy Upper School, which was approved by the City Council on June 27, 2007, has been accepted by the Massachusetts School Building Authority (MSBA). Referred to the Committee on Ways and Means. Councilor Connolly moved reconsideration. Reconsideration prevailed. Referred to the Committee on Ways and Means and Education.
1542 Message and order authorizing the Department of Neighborhood Development to apply for, accept Federal FY10 Shelter Plus Care Grant funds of Seven Million Three Hundred Thousand Dollars ($7,300,000.00) from the U.S. Department of Housing and Urban Development (HUD), to renew existing rental assistance contracts for homeless persons with disabilities. On motion of Councilor Consalvo, the rules were suspended; the order was passed.
1543 Message and order authorizing the Commissioners of the Public Works Department and the Property and Construction Management Department, and the Directors of the Public Facilities Department and the Environment Department to accept and expend a grant of Five Million Dollars ($5,000,000.00) (grant includes the value of the rebates and equipment) from NStar for the purpose of promoting energy efficiency and energy savings to various public buildings infrastructure projects. Referred to the Committee on Environment and Health.
1544 Message and order authorizing the Commissioners of the Public Works Department and the Property and Construction Management Department, and the Directors of the Public Facilities Department and the Environment Department to accept and expend efficiency rebates and the donation of equipment from NSTAR for the purpose of promoting energy efficiency and energy savings to various public buildings and infrastructure projects. Referred to the Committee on Environment and Health.
1545 Message and order authorizing the Police Commissioner to accept and expend a grant of One Million Six Hundred Fifty Thousand Dollars $1,650,000.00 from the Massachusetts Executive Office of Public Safety’s Senator Charles E. Shannon, Jr. Community Safety Initiative Grant, for the purpose of supporting strategies to address youth, gang and gun violence. Referred to the Committee on Public Safety.
1546 Message and order approving an appropriation of $550,000.00 for the feasibility study for major rehabilitation of the Dearborn School. The statement of interest for the Dearborn School, which was approved by the City Council on June 27, 2007, has been accepted by the Massachusetts School Building Authority (MSBA). Referred to the Committee on Ways and Means and Education.
1547 Message and order authorizing the City to permanently dedicate Laviscount Park for park purposes in accordance with M.G.L. Chapter 45, Section 14 and to have the administration take such other actions as needed to so dedicate this park for park purposes in accordance with the terms and conditions of a $329,382.00 grant awarded by the Division of Conservation Services in the Mass. Executive Office of Energy and Environmental Affairs. Referred to the Committee on City and Neighborhood Services and Veterans Affairs.
1548 Message and order authorizing the City to permanently dedicate Alvah Kittredge Park for park purposes in accordance with M.G.L. Chapter 45, Section 3 and to have the administration take such other actions as needed to so dedicate this park for park purposes in accordance with the terms and conditions of a $310,648.00 grant awarded by the Division of Conservation Services in the Mass. Executive Office of Energy and Environmental Affairs. Referred to the Committee on City and Neighborhood Services and Veterans Affairs.
1549 Message and order authorizing the Police Commissioner to accept and expend the FY11 Funds to Increase Crash Reporting to Enhance Highway Safety Planning and Programming grant of $287,500.00 from the Executive Office of Public Safety and Security used to identify a sustainable, cost-effective process for transmitting crash reports to the Registry of Motor Vehicles in a timely fashion. Referred to the Committee on Public Safety.
1550 Message and order authorizing the Mayor to accept and expend the Commonwealth of Massachusetts Federal FY2007 Citizen Corp Program grant of $13,800.00 to coordinate the involvement of community members and organizations in emergency preparedness, planning, mitigation, response and recovery. Referred to the Committee on Public Safety.
1551 Message and order authorizing the City to accept and expend a grant of $16,200.00 form the U.S. Department of Homeland Security (DHS), Citizen Corps Program (CCP) to coordinate the involvement of community members and organizations in emergency preparedness, planning, mitigation, response and recovery. Referred to the Committee on Public Safety.
1552 Message and order authorizing the Police Department to accept a donation of one treadmill from the Boston Police Runner’s Club, for use in the fitness center at the Police Academy. On motion of Councilor Murphy, the rules were suspended; the order was passed.

1538 Councilor Connolly, on behalf of the Committee on Environment and Health, submitted the following: On the message and order, referred on November 3, 2010 Docket #1538, to accept provisions of Appendix 120.AA of Massachusetts Board of Building Regulations and Standards also known as stretch energy code, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed; yeas 12, nays 0.

1589 Councilor Yancey offered the following: Resolution in memory of Julian Maynard Saunders. The matters contained within the Consent Agenda were severally adopted. Adjourned at 1:40 p.m. on motion of President Ross in memory of Barbara Lebedew, William “Billy” Mahoney, Mary Collins, Julian Saunders, Prime Minister David John Howard Thompson, Pat Rosa, Lawrence O’Keefe, Barbara Epstein, Patrick Connolly and Robert Burd, to meet again on Wednesday December 1, 2010 at 12:00 p.m. The papers acted upon at the foregoing meeting of the City Council, which contain action requiring the approval of the Mayor, were deposited in the Mayor’s Office on November 19, 2010.
